Forever New 20 Year Anniversary Scarf Gift | Terms and Conditions

1.    This offer is available only to select Forever New customers who have been identified in advance by Forever New as eligible to receive the gift, based on Forever New’s customer loyalty and campaign eligibility criteria ("Eligible Customers"). 

2.    This offer is personal to the eligible customer who has directly received an offer via email, SMS or MMS communication from Forever New.  

3.    Eligible Customers will receive one (1) Forever New 20 Year Anniversary scarf ("the Gift"). Limit of one Gift per customer, regardless of the number of accounts or email addresses held. 

4.    No purchase is required to receive the Gift. It is not transferable and cannot be exchanged, redeemed for cash, or substituted for anything else of value or any other Forever New product. 

5.    Depending on availability and location, the Gift will either be shipped free of charge to the delivery address (within Australia or New Zealand, as applicable) that you confirm or made available for collection at a Forever New store at a location specified by Forever New in its discretion. The fulfillment method applicable to you, and any other terms or instructions that apply to the offer in addition to these terms, will be specified in your offer communication.

6.    If shipped, while Forever New will take reasonable precautions in arranging delivery of the Gift to you, Forever New is not responsible for Gifts that cannot be or are not delivered due to an incorrect, incomplete, or unconfirmed address provided by you, or for circumstances beyond its reasonable control, including loss or theft occurring after the Gift has been delivered to the confirmed delivery address.Delivery may take up to 14 days upon you providing confirmation of your delivery address.  

7.    If collected in store, the Gift must be collected by the deadline stated in your offer communication. Your Gift cannot be collected by anyone else other than you, and proof of identity may be required.  

8.    Gifts not confirmed (if shipped) or collected (if in store) by the deadline are deemed not accepted by you, this offer and your entitlement to the Gift will lapse, and the Gift may be reallocated. 

9.    This offer and the Gift are strictly subject to availability and while stocks last[MM2.1]. If the Gift becomes unavailable or stock is exhausted, Forever New is not required to provide a cash alternative, substitute Gift, compensation or other Forever New product, subject always to any rights or remedies that cannot lawfully be excluded.

10.    Images used in marketing materials are for illustrative purposes only and minor variations in colour, appearance or packaging may occur. 

11.    This offer is valid in Australia and New Zealand only. Availability and collection arrangements may vary by region and instructions specified to you may be provided in the offer communication. 

12.    Personal information collected as part of this offer (including delivery addresses) will be used for the purpose of fulfilling the Gift. For further information on how Forever New handles personal information it collects, please also see our Privacy Policy.

13.    Forever New may modify, suspend or withdraw this offer where it is reasonably necessary to do so because of circumstances beyond Forever New's reasonable control or where necessary to address an error, fraud, technical failure, operational, legal or regulatory requirement. Where reasonably practicable, Forever New will notify affected Eligible Customers of any material change. Nothing in these terms limits any rights that cannot lawfully be excluded.

Games of Chance - 20 Years of Forever New Instagram Competition | Terms and Conditions

1.    Information on how to enter forms part of these Terms and Conditions. Entry into this Competition is deemed to be an acceptance of these Terms and Conditions. 

2.    The Competition commences on 11th October, 2026 AEST and concludes 18th of October, 2026 AEST.

3.    Entry is open to Australian residents who are 18 years of age or older as of the beginning of the Competition Period, who are not an employee of the Promoter or any of its affiliated companies or domiciled with an employee of the Promoter or any of its advertising or promotional agencies. 

4.    To enter this Competition, entrants must during the Competition Period visit the @forevernew_official Instagram page and:  

a.    Follow @forevernew_official Instagram Account
b.    Like the @forevernew_official ’20 Years of Forever New’ Competition Post
c.    Tag a friend by commenting in the comments section on ’20 Years of Forever New’ Competition Post during the competition period (1 comment = 1 entry)
d.    If the entrant shares the ’20 Years of Forever New’ Competition Post to their Instagram Story, they will receive 1 additional entry. 

5.    The draw will take place on 19th October, 2026 AEST at Building 8, Level 1, 584 Swan Street, Burnley, Victoria 3121. The prize will be drawn in accordance with these Terms and Conditions. 

6.    There will be 20 winners of this Competition. The 20 valid entries will be drawn at random and will receive a Forever New Gift Card to the value of AUD $200. The Prize is subject to availability, must be accepted as awarded and is not transferable, redeemable or refundable for cash.  Any unused portions or elements of the Prize are forfeited. [If gift vouchers are a prize: Lost, stolen or damaged vouchers will not be replaced or refunded].  

7.    The winner will be notified in writing within 2 days of the draw date (using contact details provided to the Promoter) and will be published on https://www.forevernew.com.au/terms and announced via @forevernew_official on Instagram. 

8.    The Promoter’s decision regarding any aspect of this Competition is final and no correspondence will be entered into.  

9.    The Prize must be accepted as awarded and is not transferable or redeemable for cash. Any ancillary costs associated with redeeming the Prize is the sole responsibility of the winner. The maximum total prize pool is AUD $200 which is correct at the time of publication.  The Promoter accepts no responsibility for any variation in the Prize value.   If any element of the Prize is not available due to unforeseen circumstances, the Promoter may provide a substitute prize of equal or greater value.  

10.    If the Prize remains unclaimed after 3 months of the draw date, the right of the winner to receive the Prize is extinguished. At the end of 3 months, the prize will be redrawn on 19th January, 2027 at Building 8, Level 1, 584 Swan Street, Burnley, Victoria 3121. This draw will be made up of all participants who have entered the Competition. The winner will be notified in writing within 2 days of the draw and published on https://www.forevernew.com.au/terms

11.    The Promoter will take all reasonable steps to deliver the Prize to the winner within 28 days of the draw date. 

12.    Entrants who provide incorrect or fraudulent information are ineligible to participate in the Competition. Any attempt to enter multiple email addresses or pen names, copy another person’s work, or any use of robotic, automatic, programmed or any other entry method not authorized by these Terms and Conditions is not permitted. No responsibility is accepted for any entries that are incomplete, incomprehensible, late, lost, misdirected or not received by the Promoter within the Competition Period. 

13.    This Promotion may be promoted through third party websites such as Facebook, Instagram and TikTok.  Entrants must at all times comply with the terms of service for those third-party websites when using them to participate in this Competition.  This Competition is in no way sponsored, endorsed or administered by, or associated with, those third-party websites.

14.    The Promoter and its associated agencies and companies and third party websites specified in clause 13 will not be liable for any damage or loss whatsoever suffered or sustained regarding this Competition or prizes awarded in the course of this Competition, except for liability which cannot be excluded by law (in which case that liability is limited to the minimum permitted by law). 

15.    The Promoter and its associated agencies and companies and third party websites specified in clause 13 are not liable for any incorrect, incomplete, or inaccurate information received or not received or any problems or technical failures (including any internet, telecommunications or website technical problems or any damage to computers) in the course of or in connection with this Competition if the deficiency is occasioned by any cause outside the Promoter’s reasonable control including but not limited to technical malfunctions or failures. 

16.    The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached these Terms and Conditions, or engaged in any unlawful or improper conduct calculated to jeopardize the fair and proper conduct of the Competition. The Promoter also reserves the right to request appropriate identification or other documentation to confirm an entrant’s eligibility to enter and claim the Prize. If the identity of an entrant has not been verified or validated to the Promoter’s satisfaction, that entry will be deemed invalid. 

17.    If for any reason this Competition is incapable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, the Promoter reserves the right in its sole discretion to suspend, cancel, terminate or modify or recommence the Competition, subject to the approval or directions of a relevant regulatory authority. 

18.    At the request of the Promoter, all winners agree to participate in any promotional activities planned by the Promoter and consent to their name and image being used in the Promoter’s marketing materials. 

19.    All entries become the property of the Promoter. The Promoter collects entrants’ personal information to conduct the Competition. Entrants who do not fulfill the requirements of the entry process will not be eligible to participate in the Competition. By entering this Competition entrants agree that: (1) the Promoter may disclose personal information to its contractors and agents for the purpose of assisting in the conduct of this Competition; and (2) the Promoter may retain and use personal information for future marketing purposes in relations to its products, services, and offers without compensation to the entrant.  By subscribing to receive the Promoter’s marketing communications and entering this Competition, entrants consent to the Promoter collecting their personal information in accordance with the Promoter’s privacy policy, available at https://www.forevernew.com.au/policy. 

20.    The Terms and Conditions are governed by the laws of Australia and any dispute shall be subject to the exclusive jurisdiction of the Australian Courts.
